Terry family settles lawsuit over fatal U.S. 95 construction-beam crash

The family of Las Vegas Metropolitan Police Department Detective Justin Terry has settled its wrongful-death lawsuit against two construction companies over his 2022 death on U.S. 95 in the northwest valley.

Terry’s widow and two sons sued Western States Contracting and Las Vegas Paving. A settlement was reached as jury selection was underway Monday in Clark County District Court, according to a transcript of the proceedings. The terms were not made public.

Terry, 45, was driving southbound near the Centennial Bowl in an unmarked police vehicle when a beam fell onto his car. Nevada highway officials said at the time that a construction truck carrying an overloaded load of equipment struck an overhead warning beam, dislodging it and causing it to fall onto Terry’s vehicle behind it.

The lawsuit alleged Western States was responsible for the truck driver and the load’s clearance, while Las Vegas Paving, the project’s general contractor, was responsible for the beam. The truck driver worked for Western States, according to the case details.

Terry had served with LVMPD for nearly 21 years and was assigned to the Homicide and Sex Crimes Bureau’s Sexual Assault and Abuse Section when he died. The settlement resolves the family’s civil claims, but no financial terms or other conditions were disclosed.
