Frisco gym member alleges operators failed to prevent hidden-camera recordings
A woman suing the companies that run a Planet Fitness in Frisco says she was secretly recorded while undressed in a tanning room. Police say the arrested suspect recorded multiple women, while the lawsuit argues the gym operators should have done more to protect members.
A longtime member of a Planet Fitness in Frisco is suing the companies that own and operate the gym, alleging they failed to protect her from being secretly recorded while undressed in a private tanning room.
The woman, identified in the Collin County lawsuit as Jane Doe, says a male member recorded her without her knowledge or consent during tanning sessions. She had belonged to the gym for more than seven years, according to the lawsuit. The location is at 6951 Preston Road.
Frisco police say their investigation found that the man allegedly recorded multiple women at the gym. Investigators recovered recordings showing members in various states of undress, police said.
Police arrested Eli Phillip Rodriguez, 38, of Aubrey, and charged him with invasive visual recording. Police also said he had child pornography. The allegations are criminal accusations, and the lawsuit’s claims have not been tested in court.
The lawsuit names Excel Fitness Holdings LLC and Excel Fitness DFW 21 LLC, which own and operate the location. It accuses the companies of negligence, gross negligence and invasion of privacy, alleging they failed to secure and inspect tanning areas, train staff to spot suspicious behavior, and alert members to foreseeable risks.
The complaint also points to alleged hidden-camera and secret-recording incidents at Planet Fitness locations elsewhere in the country. It says incidents involving more than 55 women in Alabama, California, Illinois, Kentucky, Missouri and North Dakota date back more than a decade.
Rogge Dunn, the woman’s attorney, said customers have a reasonable expectation that a room presented as private will remain private, and argued the operators should have taken steps to safeguard members.
A Planet Fitness spokesperson said member safety and privacy are a top priority and that the franchise group is cooperating with Frisco police. The company referred questions about the investigation to authorities.
Jane Doe is seeking more than $1 million in compensatory and punitive damages and has requested a jury trial.
