Charlotte teen faces expanded charges in fatal Grassy Patch Lane shooting

A 17-year-old charged in the killing of 4-year-old Caleb Flax now faces additional counts, including six firearm-possession charges and two counts of assault with a deadly weapon. Police say more than 80 shots were fired into homes and vehicles in northwest Charlotte on Sept. 20.

A 17-year-old charged in the fatal Sept. 20 shooting of 4-year-old Caleb Flax in northwest Charlotte faces additional charges, Charlotte-Mecklenburg police announced Oct. 5. Ian Garland was already charged with murder, attempted murder, four counts of shooting into an occupied dwelling and conspiracy to commit a felony. The new charges include two more counts of shooting into an occupied dwelling, six counts of possessing a firearm as a minor, two counts of assault with a deadly weapon with intent to kill, felony conspiracy, attempted larceny of a motor vehicle and five counts of property damage. Garland, like the other teens charged in the case, is being charged as an adult. Police say at least 84 shots were fired into four occupied homes and three parked vehicles along Grassy Patch Lane, near Auten Road, shortly before 3 a.m. Two people were wounded. Flax later died at Levine Children’s Hospital from a gunshot wound to the head, and an adult woman suffered serious but non-life-threatening injuries. Authorities have described the shooting as retaliation. During an Oct. 1 court hearing, prosecutors said Garland’s home was the intended target, but gunfire struck a house two doors away. Police believe seven teenagers took part in the shooting. Four teenagers and one adult had been charged in connection with the case at the time of the announcement. The charges are allegations; court proceedings will determine the defendants’ responsibility.
