Hialeah teen ordered held without bond in apartment-complex shooting case
A 17-year-old accused of firing at people during a confrontation at the Aquabella community is now facing adult charges. His lawyer says the incident grew out of a mutual fight and plans to ask a judge to release him.
A 17-year-old accused of shooting at people during a confrontation at a Hialeah apartment complex has been transferred to adult court and ordered held without bond.
Michael Isaac Delgado was arrested Sept. 2, a day after the shooting at the Aquabella community, 11181 W. 35th Way. He now faces adult charges including attempted second-degree murder and shooting a deadly missile, along with two misdemeanor counts, according to court records. The specific misdemeanors were not identified in the available records.
Police said the confrontation followed an ongoing dispute. One person told investigators that he and friends went to the complex to meet Delgado and another 17-year-old, intending to settle the conflict. The group had agreed the previous day to a one-on-one fight, according to an arrest report.
The account in the report says a physical altercation broke out, after which Delgado drew a gun and fired into the air. The person who called 911 said Delgado chased him while firing more shots, and that bullets passed close to him. Another person told police Delgado pointed a gun toward his face and fired.
Police also said a bullet struck the driver-side rear door of a black Chevrolet Tahoe as three people tried to flee. No one inside was hit, the report said. Officers stopped the vehicle nearby and detained its four occupants.
Delgado later acknowledged having a handgun and firing once into the air, according to the report. He said the other teen also fired into the air and at the vehicle. The second teen, who was also arrested, admitted to firing once into the air, police said. It was not clear whether that teen would also be charged as an adult.
Delgado appeared in adult court Wednesday. His attorney, Omar Lopez, said he was disappointed prosecutors chose to proceed in adult court, arguing that the incident involved a mutual fight and that people in the other group also had guns. Lopez said he plans to request a hearing to seek Delgado’s release, potentially with strict conditions such as electronic monitoring and home confinement.
The shooting prompted a large police response in the area, including a nearby school lockdown. Delgado was initially arrested on two attempted-murder counts and four counts of shooting a deadly missile before the adult charges were filed.
