Las Vegas murder case against Andrew Avalos moves to Nov. 5 arraignment
A judge postponed Andrew Avalos’ arraignment while his case undergoes a review that could determine whether prosecutors seek the death penalty. Avalos is charged in the Sept. 21 fatal shooting of Kyle Prows near the Las Vegas Strip.
LAS VEGAS — A judge postponed the arraignment of Andrew Avalos, 21, on Monday as prosecutors review whether to pursue the death penalty in the case. The hearing was rescheduled for Nov. 5 after both sides agreed to the delay.
Avalos faces charges of open murder with a deadly weapon and possessing a firearm as a prohibited person in the Sept. 21 killing of Kyle Prows.
Las Vegas Metropolitan Police said officers responded at about 6:57 p.m. to reports of gunfire near the 4600 block of Grand Drive, east of the Strip. They found Prows in a parking lot with apparent gunshot wounds; he was pronounced dead at the scene.
Police said Avalos and Prows had been arguing, and that Avalos drew a firearm, shot Prows and fled before officers arrived. According to an arrest report, Avalos’ grandmother told investigators she saw Prows following Avalos through their apartment complex. She said Avalos appeared angry and threatened to fight him after Prows allegedly made a sexual remark about him.
The charges are allegations. The death-penalty review does not establish that prosecutors will seek capital punishment; the case is scheduled to return to court Nov. 5.
