Morgan Hill homicide suspect was previously arrested in two cases involving women

Roy Anthony Lopez, 37, is being held in Santa Clara County jail after his wife was found dead at a San Jose hospital. Court records show earlier arrests on suspicion of rape and spousal battery; the rape case was dropped, and the battery case ended in a sentence of volunteer work.

A 37-year-old Morgan Hill man accused of killing his wife had previously been arrested in two cases involving women, according to court records. Roy Anthony Lopez was taken into custody over the weekend on suspicion of homicide. Police said he drove his wife’s body more than 20 miles from their Morgan Hill home to Good Samaritan Hospital in San Jose, where he allegedly told people he had killed her. She was pronounced dead in the hospital parking lot. Morgan Hill police Sgt. Sean Bayard said San Jose police alerted his department after receiving a call about a man at the hospital who said he had killed his wife. Investigators believe the fatal attack happened at the couple’s home on Vintage Lane. Police said the couple’s children, ages 3, 6 and 14, were believed to have been there. Records show Lopez was arrested in November 2014 on suspicion of rape by force; prosecutors later dropped the charges. In 2010, he was arrested for battery against a spouse or cohabitant after a fight in a public place. He was ultimately sentenced to perform volunteer work in that case. Lopez remains in Santa Clara County jail while the district attorney’s office reviews the case and determines formal charges. Former prosecutor Steven Clark said a murder charge is likely. Investigators have not disclosed the cause of death, but said a gun was not used. Clark said the circumstances of the death could be significant as prosecutors assess the case, including whether the evidence supports an allegation that Lopez intended to kill his wife. The couple had been married for more than 10 years, police said. No restraining order had been filed against Lopez.
