Pennsylvania’s skill-game machines face removal from most businesses after court ruling

A statewide ban took effect Oct. 14, leaving skill-game machines legal only at licensed casinos and truck stops. The change followed a Pennsylvania Supreme Court ruling and lawmakers’ failure to establish a tax-and-regulation plan within 120 days.

Pennsylvania’s skill-game machines face removal from most businesses after court ruling

Skill-game machines are now prohibited in Pennsylvania locations other than licensed casinos and truck stops, after a statewide ban took effect at midnight Oct. 14.

State police can remove machines still operating in bars, convenience stores and nonprofit organizations. Some businesses had already begun clearing them out: Dollar Plus in Philadelphia’s University City neighborhood removed its three machines the week before the ban, and businesses and nonprofits in the Lehigh Valley were also taking machines out on Oct. 13.

The change follows a Pennsylvania Supreme Court decision issued over the summer. The court found that skill-game machines are slot machines and therefore cannot legally operate outside licensed casinos and truck stops.

Lawmakers had 120 days to create a system to tax and regulate the machines, but did not reach an agreement before the deadline. As a result, businesses that had hosted the games must remove them unless they fall within one of the permitted locations.
