Lafayette homeowner arrested after juvenile is shot near Sidon Circle

Police received calls about a disturbance and responded to the 1500 block of Sidon Circle. Investigators said a male resident of one of the units was alarmed by an alleged attempt to get inside and fired a weapon, striking the juvenile. The juvenile was taken to a local hospital. The resident remained at the scene, police said. Officers executed search and arrest warrants on Oct. 3 and arrested the resident. The charges include attempted second-degree murder, criminal attempt and first-degree assault. The specific allegations have not been proven in court. The case has raised questions about Colorado’s “Make My Day” law, which can provide protections for people who use force to defend themselves in their homes under certain circumstances. Criminal defense attorney and legal analyst David Beller said the law applies to a person’s home, not a car, front porch or business. A defendant may raise the law in court, he said, and a judge can decide whether it applies. Investigators reviewed evidence that included video recordings and witness accounts, police said. Neighbors described being unsettled by the shooting. One called the area quiet and said the news was shocking.
