Barnett trial proceeds on arson and manslaughter counts after judge dismisses murder charges
A Baltimore judge dismissed three second-degree murder counts against James Barnett in the 2022 Stricker Street fire that killed three firefighters. Jurors may still consider arson, involuntary manslaughter and reckless endangerment charges.
A Baltimore judge dismissed three second-degree murder charges Tuesday against James Barnett, who is on trial over a 2022 fire that killed three city firefighters and seriously injured a fourth.
The ruling came after prosecutors and the defense rested their cases. Barnett’s defense renewed a motion for judgment of acquittal on all counts, and the judge granted it in part about an hour later.
The judge said prosecutors had not presented enough evidence for a jury to convict Barnett of second-degree depraved-heart murder in the deaths of Fire Lt. Paul Butrim, Lt. Kelsey Sadler and Firefighter Kenny Lacayo.
The judge found there was sufficient evidence for jurors to consider the remaining charges: second-degree arson, involuntary manslaughter and reckless endangerment. The ruling does not determine whether Barnett is guilty of those offenses.
Jurors were sent home Tuesday after being told they had heard all the evidence. Closing arguments are scheduled for Wednesday morning, Oct. 14.
The Stricker Street fire in 2022 led to a partial collapse while firefighters were responding. The trial’s outcome will determine whether Barnett is held criminally responsible for the deaths and injuries under the charges that remain.
