Salem officials refer ICE use-of-force report for state, federal review
Oregon and federal authorities are set to review an incident in which immigration agents deployed chemical agents during a confrontation at a Salem shopping center. A witness described an agent spraying into a woman’s car as she sat inside.
A report on a confrontation between federal immigration agents and people gathered around their vehicles at a Salem shopping center is being sent to the Oregon Department of Justice and the U.S. Department of Homeland Security for independent review, the city said Sunday.
The incident happened Saturday, Oct. 10. Salem police said they received a call from U.S. Immigration and Customs Enforcement around 9:30 a.m. reporting that about 30 people were surrounding agents’ cars. The city also said it received several 911 calls from people reporting symptoms they attributed to tear gas.
Marta Vitela, who witnessed the encounter, said agents broke a car window and sprayed inside while a woman was in the vehicle. “She was in so much pain. She couldn’t see anything,” Vitela said.
U.S. Rep. Andrea Salinas, an Oregon Democrat, said ICE used pepper spray, pepper balls and smoke canisters against people, including children and older adults. She also accused agents of driving recklessly on Highway 99E, prompting officials to close parts of the highway. Salinas criticized the agents’ use of force and called for safer, less escalatory conduct.
The confrontation comes as the Department of Homeland Security has confirmed a nationwide ICE enforcement surge in cities with sanctuary policies. Oregon law bars state and local law enforcement from assisting federal authorities with immigration enforcement.
Oregon for All, an immigrant-rights group, said it is tracking reports through a hotline and had recorded more than 40 ICE detentions in Oregon that week. The figure is the group’s count, not an official statewide total.
The independent reviews are expected to examine the Salem incident. The available information does not say when either review will be completed.
