Bynum asks ICE to suspend non-emergency operations in Deschutes County

U.S. Rep. Janelle Bynum is asking ICE to pause non-emergency immigration enforcement in Deschutes County after a deadly shooting at a Bend elementary school. She says fear of detention is keeping some immigrant families from seeking support and returning to school.

Bynum asks ICE to suspend non-emergency operations in Deschutes County

U.S. Rep. Janelle Bynum has asked federal immigration officials to pause non-emergency enforcement in Deschutes County as the Bend community responds to last week’s shooting at Silver Rail Elementary School.

In a letter sent Wednesday to acting U.S. Immigration and Customs Enforcement Director David Venturella, the Oregon Democrat also asked ICE to avoid enforcement at schools, hospitals, counseling centers, places of worship, memorials and vigils. For any action that cannot be postponed, she requested advance notice to her office.

Bynum wrote that immigrant families have been afraid to seek mental health care, attend community gatherings and send their children back to school. Her office has also heard from parents who fear that going to retrieve their children’s belongings from the school could expose them to detention or deportation, she said.

A 16-year-old former student killed three students and a teacher and wounded another student and teacher at Silver Rail last Thursday, according to the account in Bynum’s letter. A teacher tackled the gunman before a father who had followed him into the school shot and killed him, police said.

Bend-La Pine Schools reopened Wednesday, with Silver Rail remaining closed. Bynum said immigrant families at the school come from varied backgrounds and that some are avoiding services established to help them cope with the shooting.

“Pausing enforcement is not a political concession,” Bynum wrote. “It is basic decency and professionalism.” She said federal agencies adjust operations after emergencies so people can seek aid without fear, and argued the aftermath of a school shooting warrants similar consideration.

The request comes amid reports of increased immigration arrests in Oregon after the Trump administration announced plans to step up enforcement in sanctuary jurisdictions. Local immigrant-rights groups have also reported a recent rise in arrests in the state and shared accounts of ICE activity in Central Oregon. ICE and the Department of Homeland Security had not responded by Wednesday to questions about a reported surge in Deschutes County.

Oregon’s sanctuary law, reaffirmed by voters in 2018, bars state and local governments from using their resources to enforce federal immigration law without a warrant signed by a judge. Supporters say the policy helps immigrants report crimes and cooperate with police without fearing deportation.

ICE agents were in Bend last Thursday to return Rajinder Kumar to state custody. Kumar faces manslaughter charges in a crash that killed two newlyweds last November. ICE arrested him and removed him from the state this spring after he was released on bail, prompting uncertainty about whether he would face the charges in state court.
