A Marion County jail supervisor mistakenly listed Franck Anderson Bazil as a U.S. citizen after staff found an Indiana driver’s license and Social Security card, the sheriff’s office said Monday. The 31-year-old Indianapolis man is charged in an Oct. 4 hit-and-run that killed a 9-year-old boy and left a 6-year-old critically injured. The sheriff’s office said the supervisor believed the records had been entered incorrectly and changed Bazil’s citizenship and birthplace fields to the United States. The supervisor later acknowledged the change was a mistake, according to the office. Bazil was arrested by U.S. Customs and Border Protection in January 2024 for “Alien Inadmissibility,” the sheriff’s office said. An Immigration and Customs Enforcement spokesperson said Bazil entered the country illegally on Jan. 7, 2024, and was later released. Bazil’s attorney told a judge last week that he is not a U.S. citizen. The sheriff’s office said it could not independently verify Bazil’s immigration status or explain how he obtained his license or Social Security card. The Indiana Bureau of Motor Vehicles and Social Security Administration had not responded to requests for comment as of Monday’s report. Bazil remains in custody under an ICE hold, the sheriff’s office said. Immigration attorney Dallin Lykins, who is not involved in the case, said noncitizens may qualify under certain immigration rules for driver’s licenses, Social Security cards and employment authorization. Possessing those documents does not establish U.S. citizenship. Police say the crash happened shortly after 1:30 p.m. Oct. 4 in the 6700 block of Eagle Pointe North Drive, near West 46th Street and Interstate 465. The boys were playing outside when a black Ford SUV turned onto the street and went over a curb into a grassy area, according to court documents. The 9-year-old, Roland Jerome McLain III, died at a hospital. The 6-year-old was hospitalized with internal injuries and remained in critical condition, court records say. Both boys attended school in the Metropolitan School District of Pike Township, which made grief counselors and a crisis response team available. Court documents allege the driver briefly got out after striking the children, then drove away. Police arrested Bazil later that day after investigating witness accounts and video, using license-plate reader information to help locate the SUV. Lawrence police found the vehicle at a car wash near East 56th Street and Pendleton Pike. According to the probable-cause affidavit, Bazil told detectives he had hit something while turning and left because he was scared and did not know where to go. He said he had not consumed alcohol or drugs, the documents state. Bazil was charged Oct. 6 with leaving the scene of a crash resulting in death and leaving the scene of a crash causing moderate or serious bodily injury. At an Oct. 8 hearing, a judge set a $50,000 cash bond and ordered GPS monitoring through Marion County Community Corrections, along with a no-contact order and a prohibition on possessing a gun. His attorney said Bazil had no criminal history. McLain’s grandmother, LaQuisha Moore, criticized the bond after the hearing and said she believed Bazil should remain jailed through trial. A pretrial conference is scheduled for Dec. 2, and a jury trial is set to begin Dec. 14.
