Charlotte dealership worker’s claims of repeated blows can move forward in court

A North Carolina appeals court has declined to dismiss a lawsuit alleging a Hendrick BMW supervisor repeatedly hit a worker on the head and neck. The case, filed in Mecklenburg County Superior Court last year, also accuses Hendrick Automotive Group of failing to stop the alleged conduct.

Charlotte dealership worker’s claims of repeated blows can move forward in court

A lawsuit accusing a supervisor at Hendrick BMW in Charlotte of repeatedly striking an employee on the head and neck can proceed after the N.C. Court of Appeals rejected Hendrick Automotive Group’s bid to have the case dismissed.

The worker alleges the blows were used as a motivational tactic and continued over a period of years. The lawsuit, filed last year in Mecklenburg County Superior Court, also claims the Charlotte-based dealership group did not intervene to stop the alleged abuse.

The appeals court turned down the company’s effort to end the case earlier this month. The ruling allows the lawsuit to continue; it is not a finding that the allegations are true. The claims remain allegations to be resolved through further court proceedings.
